1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Savwee Student Hub web application and website (collectively, the “Platform”), including all content, tools, features, calculators, educational materials, and services made available through the Platform.

The Platform is owned and operated by Savwee Education Sdn Bhd (Registration No.: 201701022011 (1236177-W)) (“Savwee”, “we”, “us”, or “our”), a company incorporated in accordance with the laws of Malaysia and having its registered address at Suite 23.01, Level 23, Menara Exchange 106, Kuala Lumpur, 55188, Malaysia.

By creating an account, accessing, browsing, or using the Platform in any way, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform following the posting of any changes to these Terms shall constitute your acceptance of such changes.

2. About the Platform

The Savwee Student Hub is a free educational companion tool designed to support users in developing disciplined investment habits. The Platform provides, among others, the following features:

Investment Personality Quiz - a self-assessment tool that outputs an investment personality type and a corresponding investment style based on your responses.

Compound Interest Calculator - a projection tool allowing you to model future portfolio growth based on variables you input.

Valuation Calculator - a formula-based tool where you input variables and the system computes the remaining value.

Trade Journal - a checklist-based investment journaling tool with an automated rule-based alert system, file uploads, scoring, and journaling history.

Lesson Quizzes - multiple-choice quizzes on investment concepts.

Resources Hub - curated links to external resources including brokerage platforms, video tutorials, and other educational materials.

Support Message Generator - a pre-filled message builder for WhatsApp-based support requests.

Savwee reserves the right to add, modify, suspend, or discontinue any feature of the Platform at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.

3. Eligibility

You must be at least eighteen (18) years of age to use this Platform. By creating an account, you represent and warrant that you are of legal age and have full capacity, authority and power to enter into and bind yourself by these Terms and to exercise your rights and perform your obligations hereunder.

If you are accessing the Platform on behalf of a company, organisation, or other entity, you represent that you have the authority to bind such entity to these Terms.

4. Account Registration and Security

To access the Platform’s features, you must create an account using a valid email address and password. You may also enable two-factor authentication (2FA) via a TOTP authenticator application for enhanced security.

Your account is specific to you and may not be shared with, transferred to, or used by any other person. You agree that you will not permit any other person to use your account.

You are responsible for:

Maintaining the confidentiality of your login credentials and 2FA codes.

All activities that occur under your account, whether or not authorised by you.

Notifying us immediately at admin@savwee.com if you become aware of any unauthorised use of your account or any other breach of security.

Savwee shall not be liable for any loss or damage arising from your failure to secure your account credentials or from any unauthorised use of your account.

5. Educational Purpose Only - No Advice, No Recommendations

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

5.1 Educational Nature of the Platform

The Platform is designed solely for educational and informational purposes. All content, tools, calculators, quizzes, frameworks, alerts, scores, personality assessments, and any other materials provided through the Platform are educational in nature. They are intended to help you develop your own investment thinking and analytical skills. None of the content on the Platform constitutes financial advice, investment advice, trading advice, or any form of professional recommendation.

5.2 Savwee Does Not Give Advice or Recommendations

Savwee Education Sdn Bhd is an investment education company. It is not a licensed financial advisor, broker, dealer, fund manager, or investment bank. Savwee does not give, provide, or purport to give any financial advice, investment advice, or recommendation of any kind, whether through the Platform or otherwise. Use of the Platform does not create a financial advisory relationship, fiduciary relationship, client-advisor relationship, or any professional-client relationship between you and Savwee.

5.3 No Recommendation to Buy, Sell, or Hold

Nothing on the Platform constitutes, or shall be construed as, a recommendation, solicitation, or offer to buy, sell, or hold any security, financial product, or investment of any kind. All tools, checklists, alerts, valuation outputs, compound interest projections, personality quiz results, and all other content are self-service educational frameworks - they are not buy or sell signals, investment recommendations, or advice of any nature.

5.4 Your Responsibility - Own Risk

You acknowledge and agree that:

You are free, at all times and in your sole discretion, to accept or reject any information or educational content provided through the Platform.

If you elect to apply any concept, framework, or information obtained from the Platform to your investment decisions, you do so entirely at your own risk and Savwee shall in no circumstances be liable for any losses incurred by you.

You are acting for your own account and have made your own independent decisions in using the Platform.

You have not relied on any representations made by Savwee or its representatives in making any investment decision, unless such representations have been put into writing and expressly included in these Terms.

You should always conduct your own independent research and due diligence before making any investment decision.

You should always consult a qualified and licensed financial professional who is authorised to provide personalised financial advice in your jurisdiction.

You should always consider your personal financial situation, investment objectives, risk tolerance, and experience before acting on any information obtained through the Platform.

5.5 No Guarantee of Performance or Profits

Savwee does not guarantee the future performance of any investment or any specific level of performance, the success of any investment strategy or framework, or that any tool or educational content provided through the Platform will generate profits for you. You acknowledge and agree that no assurance, representation, or guarantee has been given to you by Savwee, its officers, employees, coaches, agents, or representatives that using the Platform will lead to any particular financial outcome. Any projections, calculations, or modelled scenarios that may be generated through the Platform are based on the variables you input and are for illustrative purposes only - they are not predictions, promises, or forecasts.

5.6 Risk of Loss

Investing in securities involves significant risk, including the potential loss of your entire principal. Past performance of any investment does not guarantee future results. The value of investments may go down as well as up.

5.7 No Guarantee of Accuracy

While we endeavour to provide accurate educational content, the information, materials, data, and other content provided through the Platform derive from sources believed by Savwee to be reliable, and Savwee does not guarantee the correctness, accuracy, completeness, reliability, timeliness, or correct sequencing of any such information. There may be delays, omissions, or inaccuracies in the information provided, and Savwee shall not be responsible or liable for any such delays, omissions, or inaccuracies. All information is provided on an “as-is” and “as-available” basis, and you agree that you shall seek your own professional advice and obtain independent verification prior to making any investment decision.

6. User Content and Data

6.1 Your Content

You retain ownership of all content you submit to the Platform, including trade journal entries, quiz responses, personality quiz answers, calculator inputs, chart screenshots, and uploaded files (collectively, “User Content”).

By submitting User Content, you grant Savwee a non-exclusive, royalty-free, worldwide licence to store, process, and display your User Content solely for the purpose of providing the Platform’s services to you. We will not sell, share, or distribute your User Content to third parties except as described in Section 7 (Privacy and Data Protection).

6.2 Uploaded Files

You may upload chart screenshots and other supporting documents to the Platform. You represent and warrant that:

You own or have the necessary rights to upload such files.

Your uploads do not infringe the intellectual property rights of any third party.

Your uploads do not contain malware, viruses, or any harmful code.

Savwee reserves the right to remove any uploaded content that violates these Terms without prior notice.

6.3 Anonymised and Aggregated Data

Savwee may use anonymised and aggregated data derived from your use of the Platform (such as aggregate quiz scores, common alert patterns, or average scores) for the purposes of improving the Platform, creating educational content, and conducting internal research. Such data will not identify you personally.

7. Privacy and Data Protection

7.1 Applicable Law

Savwee is committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (Act 709) of Malaysia (“PDPA”) and its amendments, including the Personal Data Protection (Amendment) Act 2024.

You consent to the collection, processing, and disclosure of your personal data in accordance with these Terms and any privacy notice issued by Savwee (as amended from time to time).

7.2 Data We Collect

When you use the Platform, we may collect the following categories of personal data:

Account information: name, email address, phone number (optional).

Authentication data: hashed password, 2FA configuration.

Usage data: trade journal entries, quiz responses, calculator inputs, personality quiz results, uploaded screenshots.

Technical data: IP address, browser type, device information, access timestamps.

7.3 Purpose of Processing

We process your personal data for the following purposes:

To create and maintain your account and provide the Platform’s services.

To store and display your trade journal entries, quiz scores, and other User Content.

To generate anonymised and aggregated analytics for Platform improvement.

To communicate with you regarding your account, service updates, or support requests.

To comply with applicable legal and regulatory obligations.

7.4 Data Storage and Security

Your data is stored on cloud infrastructure provided by third-party service providers. We implement reasonable security measures including encryption in transit, row-level security policies ensuring you can only access your own data, and optional two-factor authentication.

While we take reasonable precautions, no method of electronic storage or transmission is 100% secure. Savwee cannot guarantee absolute security of your data and shall not be liable for any loss of information howsoever caused, whether as a result of any interruption, suspension, or termination of the Platform.

7.5 Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with the Platform’s services. If you delete your account, we will delete your personal data within thirty (30) days, except where retention is required by law or for legitimate business purposes.

7.6 Your Rights Under the PDPA

Under the PDPA, you have the following rights:

Right of access: You may request access to your personal data held by us.

Right of correction: You may request that we correct any inaccurate or incomplete personal data.

Right to withdraw consent: You may withdraw your consent to the processing of your personal data at any time by closing your account.

Right to object to direct marketing: You may opt out of receiving promotional communications at any time.

Right to data portability: You may request a copy of your personal data in a commonly used electronic format.

7.7 Cross-Border Data Transfer

The Platform uses third-party service providers whose servers may be located outside Malaysia. By using the Platform, you consent to the transfer of your data to servers outside Malaysia as necessary for the provision of these services, in accordance with Section 129 of the PDPA. We ensure that such transfers are carried out with appropriate safeguards.

7.8 Cookies

The Platform may use essential cookies and local session data for authentication and functionality purposes. We do not use third-party advertising trackers. We do not sell your personal data.

8. Intellectual Property

8.1 Savwee’s Intellectual Property

All content, materials, tools, designs, logos, branding, code, frameworks, methodologies, checklists, scoring systems, alert rules, educational content, quiz questions, and all other intellectual property on the Platform (“Savwee IP”) are the exclusive property of Savwee Education Sdn Bhd and are protected under applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, reverse-engineer, create derivative works from, publicly display, publish, teach, sublicence, or commercially exploit any Savwee IP without our prior written consent.

8.2 Limited Licence

Subject to your compliance with these Terms, Savwee grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial, educational purposes only. This licence does not grant you any right to use Savwee’s trademarks, service marks, or logos.

8.3 Third-Party Materials

You understand that Savwee may licence and/or rely on materials from third parties for inclusion in the Platform. Ownership of such licensed materials remains with the respective licensors, and you agree that you remain bound by the terms of such licences and that you do not obtain any proprietary rights in such third-party materials beyond the terms and conditions contained in the pertinent licence.

9. Prohibited Conduct

You agree that you shall not, whether directly or indirectly:

Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.

Attempt to gain unauthorised access to other users’ accounts, data, or any part of the Platform’s infrastructure.

Scrape, crawl, or use automated tools to extract data from the Platform.

Reverse-engineer, decompile, or attempt to extract the source code, logic, or algorithms of the Platform.

Upload content that is offensive, defamatory, infringing, or harmful.

Use the Platform or any content obtained from the Platform to provide financial advice, investment advisory services, or similar services to any third party.

Reproduce, redistribute, teach, or commercially exploit any Savwee IP, including any framework, methodology, quiz content, or alert rules.

Impersonate another person or entity, or misrepresent your affiliation with any person or entity.

Interfere with or disrupt the Platform’s operation, infrastructure, or security.

Make, procure, or spread any rumour, statement, press release, or other announcement concerning Savwee, the Platform, or these Terms without the prior written approval of Savwee, whether false, malicious, defamatory, or otherwise. You acknowledge and understand that such actions may cause irreparable damage to the reputation of Savwee and that Savwee shall be entitled to initiate action against you for all actual and anticipatory damages (whether special, general, and/or consequential), to the fullest extent permitted by law.

10. Third-Party Links and Resources

The Platform’s Resources Hub contains links to third-party websites, including brokerage platforms, video tutorials, and other external resources. These links are provided for convenience and informational purposes only.

Savwee does not endorse, control, or assume responsibility for the content, products, services, privacy practices, or availability of any third-party websites. Your use of third-party websites is at your own risk and subject to the terms and conditions of those websites.

Any brokerage account you open, any transaction you execute, or any product or service you purchase through links on the Platform is a direct relationship between you and the relevant third-party provider. Savwee is not a party to that relationship and bears no responsibility for your account, transactions, losses, or any dispute arising therefrom.

11. Limitation of Liability

11.1 Platform Provided “As Is”

The Platform and all content therein are provided on an “as is” and “as available” basis. Savwee expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

11.2 No Liability for Investment Losses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVWEE, ITS AFFILIATES, DIRECTORS, TRUSTEES, OFFICERS, EMPLOYEES, COACHES, TRAINERS, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INVESTMENT LOSSES, TRADING LOSSES, FINANCIAL LOSSES, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

Any investment decision you make based on information, tools, calculators, scores, alerts, or educational content on the Platform.

Any reliance on any checklist, valuation calculator, compound interest projections, personality quiz results, or any other tool or content.

Any errors, inaccuracies, omissions, delays, or interruptions in the Platform’s content, calculations, or services.

Any loss or damage to your data or uploaded files.

Any interruption, suspension, or termination of the Platform.

Any act or failure to act or delay of any third parties, including any broker, dealer, or service provider.

11.3 No Liability for Third-Party Actions

Savwee shall not be liable to you for any direct or incidental loss, cost, claim, liability, expense, demand, or damage whatsoever arising out of your failure or inability to use any service, tool, or resource accessed through or linked from the Platform.

11.4 Maximum Liability

In any event, Savwee’s total aggregate liability to you for all claims arising from or related to these Terms or the Platform shall not exceed Ringgit Malaysia One Hundred (RM100.00), as the Platform is provided free of charge.

12. Indemnification

You shall indemnify, defend, and hold harmless Savwee Education Sdn Bhd, its affiliates (including Savwee Research Sdn Bhd), directors, trustees, officers, employees, coaches, trainers, agents, and their respective successors, heirs, and assigns (collectively, the “Indemnitees”) from and against any and all claims, liabilities, costs, damages, losses, deficiencies, expenses, demands, and obligations of any kind or nature (including but not limited to legal costs on a solicitor-and-client basis) incurred by or imposed upon the Indemnitees or any one of them in connection with any claims, suits, actions, demands, or judgements arising out of or in connection with:

Your use of the Platform.

Any investment decision you make, whether or not influenced by the Platform’s content or tools.

Your violation of these Terms.

Your violation of any applicable law or regulation.

Any content you upload to the Platform.

Any claim by a third party arising from your use of the Platform.

13. Account Termination

13.1 Termination by You

You may delete your account at any time through the Platform’s settings. Upon deletion, your personal data will be removed in accordance with Section 7.5 of these Terms.

13.2 Termination by Savwee

Savwee reserves the right to suspend or terminate your account at any time, with or without notice, if:

You breach any provision of these Terms.

We are required to do so by law or regulatory order.

Your use of the Platform poses a security risk or could expose Savwee to legal liability.

We decide to discontinue the Platform.

13.3 Effect of Termination

Upon termination, expiry, or determination of your account:

Your access to all features and data on the Platform will be revoked.

Savwee shall delete your personal data in accordance with Section 7.5.

13.4 Survival

Sections 5 (Educational Purpose Only), 6.3 (Anonymised Data), 8 (Intellectual Property), 9 (Prohibited Conduct), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) shall survive the termination of your account and these Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

14.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be finally submitted and settled by the courts of Malaysia. The parties shall first attempt to resolve the dispute through good-faith negotiation within thirty (30) days of written notice of the dispute.

15. General Provisions

15.1 Entire Agreement

These Terms, together with any other policies referenced herein, constitute the entire agreement between you and Savwee regarding the Platform and supersede all prior agreements, representations, warranties, and understandings, whether verbal or in writing. In the event of these Terms being found inconsistent with any other document, the terms of these Terms shall prevail.

15.2 Severability

Any term, condition, or provision of these Terms which is illegal, void, prohibited, or unenforceable shall be ineffective to the extent of such illegality, voidness, prohibition, or unenforceability without invalidating the remaining provisions hereof.

15.3 Waiver

No waiver of any provision of these Terms will be effective unless it is in writing. The delay or failure by Savwee to exercise or enforce any of its rights under these Terms is not a waiver of that right, nor will any single or partial exercise of any such right preclude any other or further exercise of that right or any other right.

15.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. Savwee may, at any time and on reasonable notice to you, assign and/or transfer all or any of its rights and obligations under these Terms to another party without your approval.

15.5 Language

English is the governing language of these Terms and shall prevail over any translations. All correspondence, notices, or other documents required or permitted hereunder shall be in English.

15.6 Good Faith

In carrying out their obligations under these Terms, the parties shall have an implied obligation of good faith.

By creating an account on the Savwee Student Hub, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
